Minnesota has amended their Electrical Act and Minnesota Rules Chapter 3800 which has an effective date of
December 1, 2007. Some of the amended changes are related to requirements for the contractors license and the Power Limited Technician license. These changes include:
- Creating a waiver until December 30, 2007 for individuals seeking the Power Limited Technician license
- Registration will be required for unlicensed individuals with the Minnesota Department of Labor & Industry beginning on December 1, 2007
- The bond and insurance requirements for contractors have been increased
Waiver of Power Limited Technician License Requirement
Starting December 1, 2007, Minnesota will waive the 36 month experience requirement for any individual who has ever made application to take the Power Limited Technician license exam or who makes application by December 30, 2007. The applicant must pass the Power Limited Technician license exam before they can lawfully perform work in Minnesota. Applicants who fail the exam must wait six months before taking it again.
Unlicensed Technicians Must Register with Minnesota Department of Labor & Industry
Starting December 1, 2007, registration for an Electrical Worker, Elevator Constructor, or Power Limited Technician is required with the Minnesota Department of Labor & Industry. The registration fee is $15 annually and expires on the anniversary month of initial issue. Unlicensed individuals shall not perform electrical work required to be performed by a licensed individual unless the unlicensed individual is first registered with the Department of Labor & Industry as an unlicensed individual. No test will be required to register.
After January 1, 2008, work experience hours required to test for the Journeyman A exam, Elevator Constructor exam, Maintenance Electrician exam, and Power Limited Technician exam will only be accepted or recognized if earned while registered as an unlicensed individual. Verified hours worked before January 1, 2008 will continue to be recognized and accepted.
Experience obtained legally outside of Minnesota may also be used towards credit.
Bond Requirements for Contractors Increased from $5,000 to $25,000
Starting December 1, 2007, as a condition of licensing, each contractor shall give and maintain bond to the state in the sum of $25,000 conditioned upon the faithful and lawful performance of all work contracted for or performed by the contractor within the state of Minnesota and such bond shall be for the benefit of persons injured or suffering financial loss by reason of failure of such performance. The bond shall be filed with the commissioner and shall be in lieu of all other license bonds to any other political subdivision. Such bond shall be written by a corporate surety licensed to do business in the state of Minnesota.
Insurance Requirements for Contractors Increased from $100,000/$300,000/$25,000 to $100,000/$300,000/$50,000
Starting December 1, 2007, each contractor shall have and maintain in effect general liability insurance, which includes premises and operations insurance and products and completed operations insurance, with limits of at least $100,000 per occurrence, $300,000 aggregate limit for bodily injury, and property damage insurance with limits of at least $50,000 or a policy with a single limit for bodily injury and property damage of $300,000 per occurrence and $300,000 aggregate limits. Such insurance shall be written by an insurer licensed to do business in the state of Minnesota and each contractor shall maintain on file with the commissioner a certificate evidencing such insurance which provides that such insurance shall not be canceled without the insurer first giving 15 days written notice to the commissioner of such cancellation.
