CEDIA receives additional victory in trademark lawsuit filed by
Bose Corporation
Indianapolis, Ind. – The Custom Electronic
Design and Installation Association (CEDIA) has received another ruling
in its favor from the Trademark Trial and Appeal Board in the action
brought by Bose Corporation to cancel CEDIA’s trademark registrations
in the term “Electronic Lifestyles.” The Board denied Bose’s
motion for summary judgment and refused to consider Bose’s fraud
claims against CEDIA as to the registrations. CEDIA had previously
received a ruling that one of Bose’s claims was filed too late
and that CEDIA’s registration in the publications category could
not be canceled under the grounds that it would cause confusion in
the marketplace, as initially filed by Bose.
CEDIA’s President,
Ray Lepper, said: “We are pleased by
this latest ruling by the Trademark Trial and Appeal Board in CEDIA’s
favor. We continue to believe that this action by Bose is wholly unwarranted,
harmful to our association and represents a very misguided corporate
culture at what could otherwise be an active and productive member
of CEDIA.” Billilynne Keller, CEDIA’s Executive Director,
said: “We are confident that ultimately CEDIA will prevail in
the entire trademark action, and I hope that at that time it is not
too late for Bose to repair the damage it has done to the association
and, perhaps, to Bose’s reputation in the industry.”
